“申请—考核”制下导师作为基层学术主体在招生过程中扮演核心角色,掌握考核录取的实际招生权。科研自由与教授治学是理解博士生导师招生权存在正当性的理论基础。然而,导师招生权的权力属性使其存在滥用可能,控权规则、权利救济等约束机制的缺失引发公众对博士生招生制度的质疑。美国大学的博士生招生管理模式因集体决策、行政制衡以及学术自律等机制的设计颇具科学性与公平性。我国可以此为鉴,将导师招生权力置于制度控制之下,通过限缩自由裁量空间、推行招录集体决议制、明确导师违法责任、完善程序性规则以及强化导师队伍师德建设等多重手段,让导师招生权在合法、规范、有限的前提下发挥应有价值。 |

In the Application-Assessment System, the supervisor, as the grassroots academic responsible person, plays a core role in the enrollment process and holds the actual enrollment authority for assessment and admission. The scientific research freedom and professors’ academic governance is the theoretical basis for understanding the legitimacy of doctoral supervisors’ authority to recruit students. However, the attribute of supervisors’ authority to recruit students makes power abuse possible. The lack of restraint mechanisms, such as rule of accountability and right of relief, has raised public doubts about the doctoral student recruitment system. The mode of American universities’ doctoral student recruitment management is highly scientific and fair thanks to well-designed mechanisms such as collective decision-making, administrative checks and balances, and academic self-discipline, which China can learn from and put supervisors’ recruitment authority under institutional control. The authors believe that by taking multiple measures such as limiting discretionary power, implementing a collective decision-making system for recruitment, clarifying supervisors’legal responsibilities, improving procedural rules, and strengthening the professional ethics of the supervisor team, the value of the recruitment authority of supervisors can be maximized under the premise of legality, standardization, and limitation. |
